- PROMOTING SUBJECT
Martinucci Laboratory srl with registered office in Via S.Moro, 8 – 73040 Specchia (LE), CF/P.I-. 04389050750 (hereinafter “Promoter”). - NAME OF PROMOTION
“Martinucci Friend” (hereinafter “Initiative”). - DURATION OF THE INITIATIVE
The initiative runs from May 10, 2023 and will end on December 31, 2023 (hereinafter “Duration”) unless the Initiative is extended, which will be promptly communicated by the Promoter and will be indicated in these Terms and Conditions. If the customer, within 15 days of receipt of any notice of extension, does not notify the customer service department info@martinuccilaboratory.it that he/she wishes to withdraw from the Initiative, these terms and conditions will also apply to the new Duration determined by the extension.Credits may be accumulated throughout the duration of the Initiative and may be used as vouchers (upon reaching the thresholds specified in Section 8) starting on May 10, 2023 and ending on December 31, 2023.Any periods during which conversion will not be possible will be promptly and fully communicated. - AREA OF DEVELOPMENT
The initiative will take place both on the website https://shop.martinuccilaboratory.it/ (hereinafter referred to as the “Site”) and at participating Martinucci Laboratory srl branded points of sale located in Italy (hereinafter referred to as “Points of Sale”). - PURPOSE OF THE INITIATIVE
The purpose of the Initiative is to encourage attendance and purchases both at the Points of Sale and on the Site. The “Martinucci Friend” card (hereinafter referred to as the “Card”), issued in accordance with point 6 below, enables the titular Participant to participate in the Initiative: during the Term, by making purchases at any point of purchase within the Points of Sale and/or on the Site, in the manner set out in these Rules, credits are acquired on the Card itself in order to obtain a Martinucci Laboratory voucher as specified below, to be spent exclusively at the Points of Sale.The following are excluded from the Initiative, as they do not generate the relevant credits:
– shipping costs; - RECIPIENTS
All end-customers, natural persons, residents and/or domiciled in Italy, Vatican City or the Republic of San Marino, over 16 years of age on the date of registration, which must take place in the manner specified below (hereinafter “Participants”), may participate in the Initiative.Excluded from the Initiative are all legal persons, VAT-registered persons, professional operators, resellers and, in general, all persons who do not fall within the definition of Participants.As a further clarification of the foregoing, it should be noted that, at the customer’s request, an invoice may be issued indicating only the tax code and not the VAT number. - PARTICIPATION METHODS
The Promoter, in order to incentivize purchases of the products sold and marketed at the Points of Sale and on the Site, organizes the Initiative, with unfolding as specified below.In particular, all Participants who have not yet done so, will be entitled to register for the Initiative and apply for the Card, as of May 10, 2023, according to the following procedures:
Online: through the website https://martinuccilaboratory.it/fidelity/ after entering the data online and having read the privacy policy and these Rules and sent the request through the form, a digital Card will be sent to the Participant at the email address indicated during registration.Regarding the Card, please note the following:- each Participant, identified by the personal data released, may apply for and obtain only one Card;
- the Card is free, personal and non-transferable to third parties;
- the Card is usable throughout the Term for any additional promotional initiatives that will be communicated by the Promoter;
- changes in the master data used for registration, use, theft, loss and/or malfunction of the Card must be reported promptly by writing to customer service info@martinuccilaboratory.it. The Promoter disclaims all liability for illegitimate or improper use of the Card and for any damages that may result to Participants and/or third parties, reserving, however, the right to take legal action to protect its rights in this regard;
- the Promoter further excludes any liability arising from any entry by Participants of false or incorrect information. The Promoter reserves the right to be able to require Participants to prove the truthfulness of the information provided during registration in order to prevent, but not limited to, fraud and conduct contrary to these Rules as well as the law;
- in case of established fraudulent or abusive use of the Card, as well as in case of violation of these Rules, the Promoter reserves the right to suspend the Card, inhibiting the possibility of using the accrued credits and to obtain their return;
- the Cardholder is reserved the right to revoke membership in the Initiative upon written notice to the Promoter or by e-mail to the following address info@martinuccilaboratory.it or through the reserved area on the Site and return the Card to the Promoter.During the Duration, Participants will accumulate credits on their Card by making purchases at any Store and/or on the Site.In particular, a credit of 5% will be recognized for all purchases made during the Duration as resulting from the purchase document including VAT, net of the exclusions indicated in paragraph 5 above: in the case of discounts, promotions, giveaways, tie-in sales, coupons or vouchers etc, the credits are calculated on the discounted amount.The Promoter reserves the right to adopt improved conditions by awarding Participants additional extra free credits for purchases made in certain periods or on certain products.Participants will be informed in advance through the means of communication provided (e-mail address left during registration) and/or by other means of information deemed suitable and evaluated from time to time.With regard to the individual promotional campaigns put in place by the Promoter, for each of them any exclusions and limitations will be clearly indicated, which may affect certain product families or certain types of Cards: it is therefore recommended that Participants check and verify for each Promotional Initiative any limitations.In addition, there may be special campaigns aimed at specific groups of customers in agreement or, again, promotional offers targeted at Participants who had given their commercial consent: these campaigns will be targeted and communicated directly to the target audience.In order to obtain the 5% credit (which, barring delays in data loading, will be recorded indicatively from the day after the purchase or from the processing of the order in the case of online purchases) it will be necessary for the Participant to show during the Duration the Card at the cashier’s desk at each purchase, before the issuance of the receipt or to enter his/her Card number on the Site, before completing the transaction: in the absence of such request, it will not be possible to request, after the issuance of the purchase document, the credit on the Card for any reason.Credits may not be transferred from one Card to another different Card, even if signed by the same person: similarly, the credits obtained may not be transferred, will be personal and usable only by the Participant holder of the Card on which they have been accumulated. The credit balance may be viewed at https://martinuccilaboratory.it/fidelity-card-resume/ and will be communicated monthly to the Participant via e-mail.
- CONVERSION OF CREDITS
The credits from time to time obtained by the Participant are automatically accumulated on the Card, exclusively during the Term, through the Promoter’s computer system. The credits accumulated by the Participant may be redeemed for Martinucci Friend vouchers with a unit value of €5.00 or multiples thereof as of May 10, 2023 and no later than December 31, 2023, subject to any periods of exclusion that will be promptly communicated. Each voucher must be used in full for the payment of an expenditure of an amount greater than € 10.00: in the event of purchases for amounts below this minimum threshold, the voucher may not be used.The use of Martinucci Friend vouchers must be made at any point of purchase within the Points of Sale participating in the initiative, at the time of payment of the expenditure made and upon direct request of the Participant: in the event of use, the credits on the Card will be immediately deducted and may not in any way be credited again after the issuance of the purchase document.It is not possible to cancel or modify the request to convert the credits into a Martinucci Friend voucher once it has been made.The Participant’s failure to use the credits to obtain the Martinucci Friend voucher by the deadline of December 31, 2023 determines the forfeiture of any right with waiver of any and all claims in this regard: the Promoter cannot be held responsible for the Participant’s failure to use the credits.In the event of partial return and total cancellation of the expenditure made through the use of the Martinucci Friend voucher, the credits will be returned to the Participant. - REQUEST FOR ASSISTANCE
For any information related to the Initiative or in case of need, the Participant has the opportunity to request assistance from the Promoter by writing to the e-mail address info@martinuccilaboratory.it. - SUSPENSION OR ANTICIPATED TERMINATION OF THE INITIATIVE
The Promoter reserves the right to suspend or terminate the Initiative prior to the date specified in Article 3 only for good cause, in accordance with applicable law. Early termination and suspension will be communicated to Participants at least 30 days in advance – and with respect to suspension – as far in advance as possible or immediately following such suspension. Such notice may be made by the Promoter through the Site and by e-mail communication to the address provided by the Participants during registration.In any case, in the event of early termination of the Initiative, Participants will be able to redeem credits within 3 months after the end of the Initiative. Redemption of credits will no longer be possible after the expiration of this deadline. - ADVERTISING
The means of communication used to promote the initiative are: the Site, social media, promotional material created ad hoc at the Points of Sale and sending DEM to Participants who have consented to receive commercial communications.The full rules will always be available on the Site where present. - ADEMPEMENTS AND GUARANTEES
The Promoter, in its capacity as data controller, declares that the participation and management of the Initiative presupposes the processing of personal data indispensable for the participation and management of the initiative itself. Such processing will take place in compliance with Regulation (EU) 679/2016 and Legislative Decree 196/2003 as amended, in accordance with the privacy policy adopted by the same.The Promoter reserves the right to carry out all the checks necessary to verify the correct participation in the Initiative and in case of ascertained irregularities, the Martinucci Friend card may not be recognized.The Initiative cannot be combined with other promotions obtainable from other cards or conventions in existence with the Promoter, unless otherwise indicated and communicated to specific target Participants.The full and updated version of the Initiative Regulations and privacy policy are always available on the Site.
